This Terms also apply to your use of other ESI’s services, including but not limited to the related services, features and game support, online communities, or social network services offered platform, that display or include this Terms (“Additional Services”). In this Terms, the Website, Application, and Additional Services of KIKO Games are collectively referred to as the “Services”.

 

Please review this Terms, our policies and instructions to understand how you can and cannot use our Services. You must comply with this Terms in your use of our Services and only use our Services as permitted by applicable laws and regulations, wherever you may be when you use them. By using the Services, you accept and agree to be bound and abide by this Terms and its changes and/or amendment in the future. If you do not want to agree to this Terms, then you agree not to use the Service.

 

If you are using our Services on behalf of a company, partnership, association, government or other organization (your “Organization”), you warrant that you are authorized to do so and that you are authorized to bind your Organization to this Terms. In such circumstances “you” will include your Organization.

 

You must follow applicable laws of the jurisdiction where you are located when visiting our Services. If any applicable laws restrict or forbid you from using our Services, you shall follow such restrictions or stop visiting or using our Services.

 

You hereby agrees and permits ESI to store and use your personal data for the benefit of ESI and/or any of its affiliates and/or any company within the scope of the MNC group including but not limited to PT Media Nusantara Citra, Tbk., PT Global Mediacom, Tbk., PT MNC Studios International, Tbk., and/or PT Multi Vision Network, Tbk., (“MNC Group”) and/or third parties appointed by ESI.

 

You hereby agree that any data and information filled in by you including but not limited to electronic information and/or electronic documents and/or printouts stored in ESI database are legal evidence that can be used by ESI.

 

1. PRIVACY POLICY

Usage of the Services and collection of your information is also governed by our Privacy Policy, please review it carefully to understand our practices. The Privacy Policy is incorporated by reference and made part of this Terms. Thus, by agreeing to this Terms, you agree that your presence on the Website/Application and use of the Services are governed by our Privacy Policy in effect at the time of your use.

 

2. CHANGES/AMENDMENT TO THE TERMS

ESI is entitled to change/amend this Terms at any time. You understand and agree that the aforesaid changes/amendment will be automatically deemed as an integral part of this Terms. You should look at this Terms regularly, which are posted on the Website/Application and are accessible via a link at the bottom of every page. The changed/amended Terms will be in effect immediately after being posted on this page. Your continued use of our Services following any such modification of the Terms constitutes your acceptance to be bound by the Terms as so modified.

 

3. ACCESSING THE SERVICES AND ACCOUNT SECURITY

The user agrees that the Services will require an internet connection with a minimum recommended bandwidth of 1 (one) Mbps. The quality on Services depends on the user’s internet bandwidth or internet provider. To avoid discomfort while playing, we recommend users to connect to our Services via a Wi-Fi network. Any fees incurred based on the use of the internet to connect to the Services will be the sole responsibility of the user.

 

We may withdraw or amend the Services, and any related service or content, or restrict access (including by means of cancellation, termination, or modification, or suspension of a user account) to all or certain users (including you) without notice and without liability to you. Additionally, due to your geographic location, the Services or some of their features, services, or content may be unavailable to you.

 

 

You understand that due to the specialty of the online games, we may update our game from time to time, which may block your access to the game for a period of time and result in the modification of the content of the game. We are not liable for any losses incurred by such updates except for those due to our intent or gross negligence. Unless under an urgent circumstance, we will inform you of such update in advance.

 

In the circumstance that our game is in a “test period” or a “beta version” or something of that kind, your access to our game may be subject to specific rules, such as limited period or limited number of users to access to the game, privilege of some users to access to the game, our reserved rights to modify or delete the game data of users, and irregular shut down of the game servers.

 

To access certain Services, you will be asked to provide registration details or other information, and in order to use such resources, all the information you provide must be correct, update, and complete. From time to time, in order to access the Services or certain games, services, or features, we may require some or all users to download updated or additional software. The terms of use of such software may be subject to separate agreement between you and ESI.

 

If you choose, or are provided with, a user name, password, or any other piece of information as part of our security procedures, you must treat such information as confidential (other than user name), and you must not disclose it to others. You must immediately notify ESI of any unauthorized use of your user name or password or any other breach of security. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. You may only access the Services through your own account. Your account is personal to you and you are prohibited from gifting, lending, transferring or otherwise permitting any other person to access or use your account. Your account name, user ID and other identifiers you adopt within our Services remains our property and we can disable, reclaim and reuse these once your account is terminated or deactivated for whatever reason by either you or us.

 

You are responsible for: (i) safeguarding your account details, including any passwords used to access your account and our Services, and (ii) all use of our Services under your account. You must promptly notify us if you know or suspect that your account or password has been compromised. We will regard all use of your account on our Services as being by you, except where we have received and acknowledged your notification to us regarding your account/password being compromised.

 

4. INTELLECTUAL PROPERTY RIGHTS

The Services, including all content, features, and functionality thereof, are owned by ESI, MNC Group, its licensors, or other providers of such material and are protected by Indonesian and international copyright, trademark, patent, and other intellectual property or proprietary rights laws.

 

You are permitted to use the Services for your personal, non-commercial use only, or legitimate business purposes related to your role as a current or prospective customer of ESI. Except as provided below, you must not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material obtained through the Services, or delete, or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Services.

 

You must not reproduce, duplicate, sell, or exploit for any commercial purposes any part of the Services, access to the Services, or use of the Services or any services or materials available through the Services.

 

For clarity, the foregoing permissions are limited to the Services, and no rights are granted with respect to any servers, computers, or databases associated with the Services.

 

5. USE OF YOUR DEVICE BY OUR SERVICES

In order for us to provide our Services to you, we may require access to and/or use of your relevant device (e.g. mobile phone, tablet or desktop computer) that you use to access that relevant Services – for example, we may need to use your device's processor and storage to complete the relevant software installation, or we may need to access your contact list to provide certain interactive functions within our Application. You agree to give us such access to and use of your device.

 

We will provide further information regarding how a particular Services use and access your device within that relevant Services or in another manner (e.g. via the relevant app store as part of the relevant Services’ installation process). You understand that if you do not provide us with such right of use or access, we may not be able to provide the relevant Services to you.

 

Any Personal Data (as defined in the Privacy Policy) that we use or access within your device will be treated in accordance with this Terms, including our Privacy Policy.

 

Please note that we are not responsible for any third party charges you incur (including any charges from your internet and telecommunication services providers) in relation to or arising from your use of our Services or software.

 

6. BILLING, PAYMENT, AND ACCOUNT BALANCE

1. All charges incurred in connection with the Services and all funds placed in the account balance are payable in advance and are not refundable in whole or in part, regardless of the payment method, except as expressly set forth in this Terms or as required by applicable law.
2. Through the Services, we may make available a prepaid balance service (“Account Balance”). Your Account Balance may only be used to obtain certain products and Services offered by ESI. To access the Account Balance you may be asked to provide registration details, including without limitation a Payment Method (defined below) and related billing address to an independent third party company (or companies) selected by us (“Processor”). You may only register for 1 (one) Account Balance per account ID.
3. You may use the following payment methods to place prepaid funds into your Account Balance: credit card, prepaid payment card, promotional code, or any other payment method as specified by ESI (“Payment Method”). Any promotional code provided to you for use as a Payment Method may be subject to additional terms and conditions associated with the promotion, offer, or coupon. When you provide a Payment Method to us for use in connection with the Account Balance, you represent that you are the authorized user of the Payment Method, and you authorize ESI to charge your Payment Method for any Account Balance funds or other fees incurred by you. If your use of the Account Balance is subject to any sales or other taxes, then we may also charge you for those taxes. You are responsible for all uses of your Account Balance, including all applicable taxes and all purchases made by you or anyone else using your Account Balance
4. Account Balance funds do not constitute a personal property right and have no value outside the Services. If you are refunded for an item purchased using Account Balance funds, we will return the funds to your Account Balance. The Account Balance funds are non-transferable to another person and do not accrue interest
5. We reserve the right to suspend or terminate your Account Balance if after investigation we determines in our sole discretion that you misused the Account Balance, conducted unauthorized Account Balance transactions from another user’s Account Balance, or used the Account Balance to conduct any fraudulent or other illegal activity. In the event that your Account Balance is terminated or suspended in accordance with this Terms for reasons other than fraudulent or other illegal activity, we will return your remaining Account Balance less any charges, fees, or other amounts owed to us. Otherwise, the Account Balances are not refundable and are not redeemable for money or monetary value from ESI or any other person or entity. The Account Balances that are deemed unclaimed property may be surrendered to the applicable authority, as required by applicable law.
6. In addition, we may also terminate your Account Balance if it is not used for a minimum period of 12 (twelve) consecutive months upon any notification to the user. User will be asked to re-register as a new user to enjoy the Services.

 

We make no warranty and accept no liability for any loss or damages whatsoever, relating to or in connection with your placement of funds to any Services with the Processor. You are solely responsible for any and all transactions utilizing your personal financial information, including, but not limited to, any and all charges. You acknowledge and agree that in the event the Processor experiences a data breach that affects your personal financial information, we will in no way be responsible or liable to you for any such breach.

 

7. PROHIBITED USES

If you are under the age of 13, you must not use our Services. If you are between the ages of 13 and 18 (or the relevant age in your jurisdiction where you are considered a minor), your parent or guardian must agree to this Terms (both for themselves and on your behalf) before you can use our Services. In some cases we may ask the user to provide us with their birth date. If such information indicates the user is under the age stipulated by the applicable laws and deemed as child under such laws, we will not collect further personal information from the child until a parent/guardian’s verifiable consent is obtained. Please ask your legal guardian’s permission to use or access our Services. If you believe ESI has inadvertently have personal information of a child without parental/guardian consent, or if you are the parent or guardian of the user and wish to withdraw consent, please inform us in contact section, so we can promptly remove the information from our records.

 

You may use the Services only for lawful purposes and in accordance with this Terms. In utilization of our Service, you are prohibited to perform the following things:

1. To access or use the Services for any purpose that is illegal or beyond the scope of the Services’ intended use (in our sole judgment).
2. Provide any false information when applying for registration user or account and update the information or use the other account ID and password illegally.
3. Reproduce, duplicate, distribute, or commercially use the information and copyright content obtained from the Services.
4. Posting any indecent content or posted a link to any indecent web pages into the Services.
5. Communicate with other parties with the information, writings, images or sounds that disturb public order and ignore the moral.
6. Use cheats, automation software (bots), hacks, mods or any other unauthorized third-party software designed to modify any part of the game, collect any information of the game or connect to the game including but not limited to simulating game user operations, changing the operating environment, modifying data to disrupt other users’ game experience through the employment of external software, including but not limited to scripts (robots), plug-ins, button wizard software or third-party tools (e.g. the multi-open function under the simulator, synchronizer, record macro, keyboard mapping, cloud phone etc.).
7. Installing or distributing material that contains computer virus which leads to malfunction of equipment related to Services, destruct the information and produce chaos.
8. Intentionally interfere to the operational Services, sending information that may interrupt the delivery of Services.
9. Distributing false information for the benefit of personal monetary profit or other parties, or the desire to harm other party.
10. Use our game for any purpose other than a reasonable person is likely to believe is within the spirit of playing, specifically including without limited to commercial purposes.
11. Reverse engineer, derive source code, modify, decompile, disassemble, or create derivative works based on our game, any content created by others or any portion thereof, in whole or in part.
12. Remove or amend any patent notice, copyright notice or other intellectual property information from our game.
13. Collect any information, other than reasonably necessary for playing the game, of other users.
14. Unless otherwise specified, transfer virtual currencies such as gold coins and points ("Virtual Money") or items or Services for use within our game ("Virtual Goods") in any way once you purchase it, including but not limited to attempting to trade the Virtual Money and/or Virtual Goods within our game with real money/real items via any third party platforms, or attempting to provide mediation, intermediary, or agency service for such trade in or outside our game (collectively “RMT”), including, but not limited to spamming, spreading RMT advertisements by any means within or outside our game, and conducting RMT via any in-game functions, etc.
15. Modify or replace the information posted on the Services.
16. Threaten other users, including stalking them.
17. Provide access to any party to consume some material that is not in accordance with social norms, ethics and/or values prevailing in society.
18. Violate the provisions of the Republic of Indonesia Penal Code, Civil Code, Act on Consumer Protection, Law on Information and Electronic Transactions, Copyright Law, or perform any other illegal, and/or criminal activity.

 

You acknowledge and agree that any violation of number 6 of this Terms is a violation of the law that can be processed both criminally and civilly by ESI or the authorities.

 

Digital Rights Managements (DRM) may be used to protect content and for further clarification, subject to software provider agreements with third parties. You are prohibited from changing, modifying, removing and/or opening Digital Rights Managements (DRM) either directly or indirectly, either partially or completely. You acknowledge and agree that such infringement is a copyright infringement.

 

You cannot directly or by using any device, such as software, internet sites, web-based services, and/or other means remove, modify, ignore, avoid, interfere with, and/or circumvent copyright, trademark, or other intellectual property rights that exist in the content or any other DRM, device, or content protection or access control mechanisms associated with the content including geo-filtering mechanisms.

 

Content and Services can be viewed, accessed, and/or used from within and outside the territory of the Republic of Indonesia (“Territory”), subject to the provisions of any content owned by other parties regarding access restrictions based on your geographic location (geo-blocking).

 

8. USER CONTRIBUTIONS

The Services contain various forums, networks, and other interactive features that allow you to post, submit, publish, display, or transmit to ESI and other users (“Post”) content or materials (“User Contributions”) on or through the Services.

 

All User Contributions must comply with the following content standards: User Contributions must not be illegal, fraudulent, deceptive, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable, and must not consist of or contain software viruses, commercial solicitation, chain letters, mass mailings, or any form of “spam”.

 

You are solely responsible for your User Contributions and we recommend that you keep a back-up copy of it at all times. You must at all times ensure that: (i) you have the rights required to submit, transmit or display your User Contributions, and to grant us the rights as set out in this Terms; and (ii) your User Contributions (and our use of your User Contributions in accordance with this Terms) does not infringe or violate the rights of any person or otherwise contravene any applicable laws or regulations.

 

Any User Contribution that you Post will be considered non-confidential and non-proprietary, and you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, copy, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Contribution throughout the world in any media; however, we will only share personal information that you provide in accordance with our Privacy Policy.

 

You represent and warrant that you own or otherwise control all of the rights to the User Contributions that you Post at the time of Posting; that the User Contributions are accurate and not fraudulent or deceptive; and that the User Contributions do not violate this Terms or the rights (intellectual property rights or otherwise) of any third party, and will not cause injury to any person or entity. You understand that your User Contributions may be copied by other Services users and discussed on and outside of the Services, and if you do not have the right to submit User Contributions for such use, it may subject you to liability. We take no responsibility and assume no liability for any content Posted by you or any third party.

 

We have the right but not the obligation to monitor and edit or remove any User Contributions. We also have the right to terminate your access to all or part of the Services for any or no reason, including without limitation, any violation of this Terms and/or any applicable law.

 

You are giving ESI and MNC Group the perpetual and free of charges rights to use your User Contributions including the rights to create derivative works of, to publicly display and to publicly perform your User Contributions, for the purposes of providing, promoting, developing and trying to improve our Services, including our relevant Services that you submitted your User Contributions in and any other Services that we may provide now or in the future. We may use the name that you submit in connection with your User Contributions (whether that be your account name, real name or otherwise). in using your User Contributions for these purposes, ESI and MNC Group may copy, reproduce, host, store, process, adapt, modify, translate, perform, distribute and publish your User Contributions worldwide in all media and by all distribution methods, including those that are developed in the future, provided that they are incorporated into our Services which you use.

 

We may share your User Contributions with third parties that we work with to help provide, promote, develop and improve our Services, but we will not sell your User Contributions to such third parties (other than our affiliate companies) for their use for their own purposes (i.e. for any purposes that are not related to our Services).

 

In addition, you agree that ESI and MNC Group (subject to this Terms, our Privacy Policy and applicable laws and regulations):

1. are allowed to retain and continue to use your User Contributions after you stop using our Services - for example, where you have shared your User Contributions with other users of our Services;
2. may be required to retain or disclose your User Contributions in order to comply with applicable laws or regulations, or in order to comply with a court order, subpoena or other legal process, or ESI and MNC Group may disclose your User Contributions in response to a lawful request by a government authority, law enforcement agency or similar body (whether situated in your jurisdiction or elsewhere); and
3. may need to disclose your User Contributions (including any information relating to your accounts with us) in order to enforce this Terms, protect our rights, property or safety, or the rights, property or safety of our affiliate companies or other users of our Services.

 

You understand that even if you seek to delete your User Contributions from our Services, it may as a technical and administrative matter take some time or not be possible to achieve this – for example, we may not be able to prevent any third party from storing or using any of your User Contributions that you have made public via our Services.

 

9. SERVICES MODIFICATION

We are entitled to modify or terminate our Services, including but not limited to the software, game engines, or any other features or functionalities to the users with or without prior notification. To the enactment of aforesaid policy, ESI shall not be liable in any kind towards the users or any third parties. Users are not permitted to make modifications in any form towards the Services without our prior written approval.

 

10. LINKING

You may link to publicly available portions of the Services if you do so in a way that is fair and does not damage or take advantage of our reputation, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part. The Services must not be framed on any other website/applications or service. We reserve the right to withdraw linking permission without notice.

 

If the Services contain links to other sites and resources provided by third parties, these links are provided for your convenience only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

 

11. DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITY, AND INDEMNIFICATION

We are continuously improving our products, Services, software, Application, games engines, or any other features or functionalities associated with our Services. The Services and all information, content, materials, products (including software), and other services included on or otherwise made available to you through the Services are provided by ESI on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Services, or the information, content, materials, products (including software), or other services included on or otherwise made available to you through the Services will be uninterrupted or error-free. You expressly agree that your use of the Services is at your sole risk. To the full extent permissible by law, we disclaim all warranties, express, or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Services, information, content, materials, products (including software), or other services included on or otherwise made available to you through the Services, our servers, or electronic communications sent from us are free of viruses or other harmful components.

 

You agree that there will be circumstances where you may encounter third party applications (including but not limited to sites, widgets, software and other utilities related to third party applications) that interact with the Service. These applications will collect user data and retrieve data related to user accounts. These applications are owned by third parties and are not related to ESI, therefore the use of these applications is at the user's own risk. The Services may contain links and instructions to other sites or other destinations. Links to and/or from the Service to other sites or destinations, maintained by third parties, do not constitute an endorsement by us of any third party sites or content. We are not responsible for the availability of such third party resources, or their content even if such sites or destinations are operated by affiliated companies or associated with ESI. By using the Service, you acknowledge and agree that ESI is not responsible to you for any content or other materials operated and served by such linked sites other than the KIKO’s official Website and Application.

 

You agree to defend, indemnify, and hold harmless ESI, MNC Group, its affiliates, and licensors, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) resulting from your contributions or violation of this Terms. To the extent permissible under applicable laws, in no event shall ESI, MNC Group, our subsidiaries, affiliates, successors, and assigns or any of our shareholders, directors, officers, employees, or licensors be liable (jointly or severally) to you for personal loss, injury or any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever.

 

The users agree to indemnify and hold harmless ESI, MNC Group, their subsidiaries and/or their affiliates, as well as directors, commissioners, officials, employees, agents, and their representatives from any claims or demands, including reasonable attorneys' fees, performed by a third party on or arising from use of the Services by the ESI’s users, violation of this Terms by users, or falsification of an intellectual property rights by users of intellectual property rights or other right possessed by any other person or entity.

 

You agree that ESI shall be free from all claims in the event of a system disturbance and/or other reasons that is beyond its control and/or ability to prevent and overcome it, so that the Services cannot be enjoyed either partially or completely, temporarily or permanently by the user, including but not limited to changes in government regulations, natural disasters such as floods, hurricanes, earthquakes, fires, wars, riots, revocation of licenses by the government, suspension or unilateral termination by content providers.

 

 

12. TERMINATION

At our solely discretion, immediately, without any cause or prior notification, we may suspend, temporary withdrawal within a specified period and/or terminate your access to the use of ESI Services: (i) if we reasonably believe that you have breached this Terms; (ii) if your use of our Services creates risk for us or for other users of our Services, gives rise to a threat of potential third party claims against us or is potentially damaging to our reputation; (iii) if you fail to use our Services for a prolonged period; or (iv) for any other reason. Where reasonably practicable, we will give you notice of any suspension or termination. Without prejudice to the changes/amends to the Terms provision, ESI is entitled to suspend and/or terminate the Services in the event of any false or mislead information provided by the user within the registration to ESI, revealed or abuse the our Services.

 

Following termination of this Terms, we will only retain and use your User Contributions in accordance with this Terms, including the Privacy Policy. Where we suspend or terminate a Service, or where your access to our Services is terminated by you or us, we do not guarantee that we will be able to return any of your User Contributions back to you and we may permanently delete your User Contributions without notice to you at any time after termination. Please ensure that you regularly back up your User Contributions.

 

13. MEASURES TAKEN TOWARDS VIOLATION OF THE TERMS BY THE USER

In the event you have infringed a part of this Terms, or have demonstrated inappropriate use to our Services, hence ESI is entitled to (i) alert such user(s) that the user(s) has violated the Terms; (ii) terminate our Services to such user(s); (iii) notify and/or fully cooperate with the law enforcement authorities or other competent authority for the subsequent step; and/or (iv) perform any other action which considered proper and appropriate according to our own sole discretion.

 

14. GOVERNING LAW AND JURISDICTION

User must comply with laws of the Republic of Indonesia, regulations under this Terms, usage instructions, and notification which posted on the screen as well as other given announcements, and do not take part of the activities which disrupt the continuity of the Services. Any dispute or claim by you arising out of or related to this Terms (“Claim”) shall be governed by Indonesian law without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, a Claim shall be instituted exclusively in the West Jakarta District Court. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

 

15. IN-APP PURCHASES

In-app purchase means an in-game system that allows exchanging real money for merchandise, virtual goods, or in-game currency. Examples of in-app purchases are items you can purchase (for real or in-game currency) or other additional feature. To secure your in-app purchase, we suggest you to enabling the require authentication feature on your device.

 

16. PROMOTIONS

We may offer any promotional program by using promotional code from time to time (“Campaign”). Please note that these may involve different conditions and requirements as it relate to the terms and conditions as provided separately hereafter (“Terms of Campaign”). All promotional code provided to you by ESI through the Services are enable to be used in exchange for a prize related to a product and/or a service.

 

By placing a promotional code through the Services, you make an exchange for a prize related to a product and/or a service subject to its Terms of Campaign. If there is any Campaign provided directly by participating merchant (“Merchant”), then the rights and authority over the Campaign will be fully under the Merchant and beyond ESI’s responsibility. The Merchant, not ESI, is the issuer of the promotional code related to products and/or services and is solely responsible for redeeming any promotional code.

 

Prize Exchange General Requirements:

1. If you fulfill all the requirements and procedures, you can choose the applicable Campaign through the Services in the form of a promotional code, which is subject to Terms of Campaign by ESI or the Merchant which is a third party (whichever is applicable) that offers certain prize, which you will exchange with the prize related to products and/or services.
2. You are required to use your promotional code within a specified time period. There is no extension of the time period for exchanging this promotional code. You agree that you will not submit any claims to us for any promotional code that have expired.
3. A promotional code that has been successfully exchanged into specific prize cannot be exchanged into any other prizes under any circumstances. There is no request for exchange of prizes to be served.
4. We may, with our sole and absolute authority, refuse your request to redeem any promotional code, for any reason including but not limited to the availability, expiry, error reason, and territory limitation.
5. To the extent permitted by the applicable laws and regulations, we have the right without prior written notice and in accordance to ESI’s policies from time to time, to:
• Modify or change the Terms of Campaign of any Campaign (including for the addition or removal of terms and conditions);
• Terminate or modify the Terms of Campaign of any Campaign;
• Revoke, adjust, and/or recalculate prize related to products and/or services that have been given to user;
• Modify the qualifications and fulfillment of requirements to earns any promotional code;
• Modify the method used to calculated the number of prize or promotional code to be awarded; and/or
• Hold or stop giving promotional code or prize.
6. Neither we nor the Merchant is responsible for lost or stolen promotional code.
7. Promotional code may not be combined with any other prize certificates, third party certificates, coupons, or promotions, unless stated explicitly.
8. Subject to the tax provisions prevail, you must be responsible for all taxes, levies, or duties arising in connection to the prize(s) and/or promotional code(s) awarded to you. The promotional code redeemed or used that you have exchange and all fees and expenses relating to these must be borne by you.
9. All promotional codes are not for sale. ESI is not responsible for any violation act such as buying, gambling, and other infringement related to the redemption of any promotional code.

 

17. ORDERS AND PAYMENT

The payment you make is subjected to sales tax in accordance to the tax provisions of your country. Online orders may be executed with real-time credit card processing.

 

18. RISK OF LOSS AND SHIPPING

Our responsibility is limited to the item(s) as long as it is still in our hand and until the receipt number is given to you. We will inform you the shipping services we used and you can track the shipment status directly to the relevant shipping services site.

 

All in-app purchase failures caused by signal connection disruption are beyond our control. To the best of our ability, we will repair such situations to its original state.

 

19. RETURN POLICY

Items in their original condition may be returned within 24 hours of received. We accept return or exchange item(s) only for defective product(s) or shipping error reason caused by us.

Our customer service representative may contact you for survey and customers inputs from time to time. In the event of any conflict between this Terms and information provided by customer service or other portions of our Website/Application, this Terms shall prevail.

 

21. MISCELLANEOUS

1. The failure of ESI to exercise or enforce any right or provision of this Terms will not operate as a waiver of such right or provision. This Terms operates to the fullest extent permissible by law. If any provision of this Terms is unlawful, void, or unenforceable, such provision is deemed severable from this Terms and does not affect the validity and enforceability of any other provisions.
2. You agree that any notices we may be required by applicable law to send to you will be effective upon we send an e-mail message to the e-mail address you have on file with ESI or publishing such notices on the informational page(s) of the Services.
3. You agree that no joint venture, partnership, employment, or agency relationship exists between you and ESI as a result of this Terms or your use of our Services. A printed version of this Terms and any notice related to it shall be admissible in judicial or administrative proceedings based upon or relating to this Terms to the same extent as other business documents and records originally generated and maintained in printed form.
4. Nothing contained in this Terms limits our right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Services or information provided to or gathered by us in connection with such use.
5. We may translate this Terms into multiple languages. In the event there is any difference between the English version and any other language version of this Terms, the English version will apply (to the extent of the difference and to the extent permitted by applicable laws and regulations).
6. This Terms are the entire agreement between you and us in relation to our Services. You agree that you will have no claim against us for any statement which is not explicitly set out in this Terms. The invalidity of any provision of this Terms (or parts of any provision) will not affect the validity or enforceability of any other provision (or the remaining parts of that provision). We may freely assign, transfer or sub-contract this Terms or our rights and obligations under this Terms, in whole or in part, without your prior consent or notice. You acknowledge and agree that in no event will our partners or affiliate companies have any liability under this Terms.
